Book Description

1998
Well-known dispute resolution educator John W. Cooley has revised and updated The Arbitrator’s Handbook for lawyers and continuing legal education arbitration courses. The Arbitrator’s Handbook, Second Edition, begins with an introduction to arbitration describing its stages, types, benefits, and limitations. Cooley defines the role, authority, and ethics requirements of the arbitrator. Cooley then examines the arbitrator’s pre-hearing duties, focusing on the initiation of the arbitration as well as the preparation stage. Chapter three focuses on the hearing, covering such topics as the arbitrator’s opening statement, handling of preliminary matters, review of basic rules of evidence, and making rulings on motions and objections. Chapter four explores the post-hearing such as ruling on post-hearing motions, deciding the merits of the case, and drafting the award and the opinion supporting the award. Chapter five, a new chapter in the second edition, covers information useful to arbitrators when conducting a cyberarbitration. Checklists are included in appendices A-D to ensure that the lawyer/arbitrator takes key actions at critical stages ! of the arbitration process. The appendix also contains updated sample arbitration forms and rules. Highlights include: The International Arbitrator Understanding Basic Principles of Evidence Ensuring Completeness and Accuracy of Transcripts Drafting the Award Domestic Arbitration Rules International Arbitration Rules

Editorial Reviews

Review

"Being concise-whether it be in describing each stage of the arbitration process or boiling down the arbitration's hearing functions into a single checklist-is one of Cooley's strengths. No wonder the book's publisher is promoting the book as a quick reference tool that can be brought to hearing sessions. A handy reference tool for arbitrators and advocates-this book definitely is." -- Dispute Resolution Journal

"Jack Cooley's new book, The Arbitrator's Handbook, is a unique contribution from a highly respected arbitrator and mediator. What is so extraordinary about this work is that the author has brilliantly accomplished what he set out to do and that is to write a book that will be of unquestioned and indispensable value not only to arbitrators, but to advocates using the arbitration process, and to teachers and law students alike. The book is beautifully written and I cannot imagine any arbitrator, or for that matter, any lawyer involoved as an advocate, ever allowing it out of their sight. I won't!" -- Leonard Jay Schrager, Professor of Law and Former Dean at The John Marshall Law School and President of The Chicago Bar Association

"This guide through all stages of the arbitration process can be used by lawyers and non-lawyers for quick reference during hearings and education programs. Chapters provide basic information on the nature of arbitration, the role and authority of the arbitrator, and the arbitrator's functions and duties during and after hearings." -- Illinois State Bar Association Bar News

"With the publication of The Arbitrator's Handbook, Jack Cooley has provided us with a wonderfully comprehensive guide to the arbitration process. This excellent addition to the arbitration literature is destined to improve arbitration practices and become the arbitrator's bible." -- James J. Alfini, Chair-elect American Bar Association Dispute Resolution Section and Professor of Law at Northern Illinois University College of Law

3.0 out of 5 stars Good Information But Too Much Filler, May 2, 2005
This review is from: Arbitrator's Handbook (Paperback)
This book contains some very good information for arbitrators, but the last 200 pages (almost half of the book) is just checklists derived from the table of contents and the rules of various arbitration associations which are available on the internet for free. The substance of the book is written in chronological order of the arbitration process and is geared more to the experienced arbitrator than a beginner. I found Allan H. Goodman's Basic Skills for the New Arbitrator (make sure you get the new second edition) to be a more concise, practical treatment of the same subject for beginners and valuable even for experienced arbitrators. Written in question-and-answer format, it teaches you rather than talks to you.
