The enormous monetary and psychological costs of a prolonged lawsuit, combined with choked court calendars in many parts of the country, have increased the use of mediation, arbitration, and other alternative dispute resolution techniques. The authors present a fictional account of two women embroiled in employment contract disputes. One goes through mediation and in six weeks has a settlement that satisfies both parties; the other settles just before trial over four years later, and spends far more.
