While secular support for capital punishment in America seems to be waning, religious conservatives, particularly in the "Bible belt," remain staunch advocates of the death penalty, citing biblical law and practice to defend government-sanctioned killing. Dale S. Recinella compares biblical teaching about the death penalty, including such passages as "eye for eye, tooth for tooth, life for life," with the nation's current system of capital punishment, and offers persuasive arguments for a faith-based moratorium on -- and eventual abolition of -- executions.

Framing his careful and incisive analysis as a legal brief to those who believe the Bible mandates the ultimate punishment, the author addresses two critical areas of inquiry: what do the scriptures tell us about who is deserving of death and who has the authority to kill, and what do they tell us about the required standards for execution and the plight of victims' families. Recinella's examination of the Hebrew Torah, or Christian Pentateuch, and the Talmud reveals that the biblical death penalty was not a simple system of swift retribution, but a complex and practical set of laws that guided capital courts established under the Sanhedrin. His scrutiny of these texts, the Christian doctrine of atonement, and Romans 13 in the Pauline Epistles, draws parallels between the traditional biblical arguments used in favor of capital punishment and those used as the basis for pro-slavery positions in the nineteenth century. Demonstrating that both approaches are unsubstantiated in biblical terms, Recinella debunks the accepted religious reasoning for support of the death penalty and shows instead that the Bible's strict conditions for sanctioning execution are at odds with the arbitrary ways in which capital punishment is administered in the United States. He provides convincing evidence that a sentence of death in today's criminal justice system in fact fails to meet both the Bible's exacting procedural requirements and its strict limitations on judicial authority.

By providing actual scriptural language and foundation to counter the position that biblical truth justifies a pro-death penalty stance, this thoughtful, solidly researched, and well-reasoned work will give pause to religious fundamentalists and challenge them to rethink their strongly held views on capital punishment.

A longtime supporter of the death penalty, Recinella underwent a radical change of heart when a colleague asked him to step out of his legal specialty to help with a murder case. That experience launched a lengthy investigation during which Recinella uncovered damning evidence that American courts administer the death penalty in ways deeply at odds with the biblical faith Americans often invoke to justify it. In the first place, Recinella shows, Americans often quote the Bible's eye-for-an-eye verses without understanding the scriptural and Talmudic context that defined the offenses meriting death. Scripture-quoting advocates of the death penalty abound in America's Bible Belt (where a disproportionate number of executions occur), but Recinella concludes that these fervent religionists have attended little to the scriptural insistence on strict equity in administering capital punishment. The Biblical Truth about America's Death Penalty is a must-read. It deals with Biblical standards of Capital Punishment and then compares them to the system used in America today. It is the best-researched, most faithful to scripture, and most evenhanded analysis I have ever read concerning the Death Penalty. Whatever your persuasion on the issue, this book will teach you a great deal. Recinella is a trained lawyer and committed Christian who now volunteers full-time on Florida's death row. He thus understands law, the Bible, and the system of execution in America. I challenge anyone who supports the Death Penalty to read this book.

This is an excellent review of the death penalty and its application in the U.S. today. Given the vociferous nature of the claim that the Bible supports the death penalty, the focus of the book is a legal analysis of what that standard is and whether the death penalty in the U.S. actually meets that standard. The author, an attorney himself, has done his research and has provided extensive citations to the authorities he relies upon, so that the reader, if interested, can check those authorities for him or her self.

The interesting thing I found about the book was that, despite its focus on the biblical standards for death and the U.S. death penalty's (lack of) compliance with those standards, it also provided a thought-provoking and, to me, scary insight into how our death penalty is administered and applied today. I hope that every person who is involved in the application and administration of the death penalty, from the legislator who votes for it, to the governor who signed the bill, to the prosecutor who prosecutes the cases, to the parol or pardon board member which decides clemency issues, reads this book.

This should be a must-read for everyone who claims to be a Christian and also supports the death penalty in the United States. I'm guessing that because the writer is a lawyer and wants to make his point bullet-proof, he repeats himself frequently, and that becomes tedious. However, the meat of the book is incredibly challenging. It is a wake-up call to use the entirety of Scripture in our approach to criminal law, rather than thoughtlessly picking and choosing sound bites to support an only marginally thought-out point of view.
