Under the guise of "tort reform," the civil justice system is under attack, according to Drivon, a veteran plaintiffs' attorney and president of the California Trial Lawyer's Association. These reforms, including attempts to limit contingency fees and punitive damages and to promote no-fault insurance, have been spearheaded, Drivon says, by health professionals, government agencies, manufacturers, and insurance companies, all of whom wish to reduce, if not eliminate, legal accountability for negligence and wrongdoing at the expense of persons least able to sustain economic loss. This is a brief but pointed analysis of one side of an increasingly important policy debate, the outcome of which will affect the future of the American legal system; for a more pro-reform viewpoint, see Peter Hubert's Liability (Basic Bks., 1988).
