Book Description

1841135127 978-1841135120 September 18, 2007
With the Treaty establishing a Constitution for Europe being the main point of reference, this book presents an integrated approach to general questions of European administrative law and offers some possible solutions to the problems which it poses. Under the Treaty, general questions of administrative law are no longer addressed merely in a fragmented or incidental way, but as a discipline that governs the exercise of sovereign powers by a supranational entity. This calls for a detailed examination of the fields which comprise European administrative law. The book therefore examines in some detail the key areas of rulemaking powers and normative instruments, the implications of the Charter of Fundamental Rights for European and national administrations, administrative procedure, and judicial protection within the European Union.

Editorial Reviews

Review

This is a major contribution by Eva Nieto-Garrido and Isaac Martin Delgado.Jacques ZillerThe Law and Politics Book ReviewVol. 18 No.7 (July 2008)...adds to the growing literature on European administrative law...The book is indeed well articulated and consistent. The authors build their case step by step, adding argument to argument to show both the possibility and the expediency of a codification of European administrative law.Roberto CarantaCommon Market Law ReviewVolume 46 Issue 1...an important contribution to the developing field of European administrative law...the book can be praised for its original approach, which departs from the Constitutional Treaty to examine the innovations which contribute to shape administrative law at EU level. The book shows a clear effort of systematisation, which this field is in need of.Dr. Mariolina EliantonioThe Web Journal of Current Legal IssuesSeptember 2009
