Book Description

1983

John Henry Faulk was a popular radio and television personality during the McCarthy era. He was host of his own radio program on WCBS in New York when he publicly challenged AWARE, Inc., an ultrapatriotic group engaged in the systematic blacklisting of entertainment personalities. In response, an AWARE bulletin accused Faulk himself of subversive associations. Angry and frightened by this accusation, Faulk brought suit against AWARE, charging conspiracy to libel him and to destroy his career. Thus began one of the great civil rights cases of this century.

John Henry Faulk recounts the story of this harrowing time in Fear on Trial, the dramatic account of his six years on the "blacklist"--an exile that began with the AWARE bulletin and ended with his vindication by a jury award of $3,500,000--the largest libel award in U.S. history at that time. The heart of the book is the trial of Faulk's libel action against AWARE, in which attorney Louis Nizer relentlessly exposed the blacklist for what it was--a cynical disdain of elementary decency couched in the rhetoric of patriotism.

Many of the people involved in the Faulk case were and are famous: attorneys Nizer and Roy Cohn; Edward R. Murrow and Charles Collingwood; Myrna Loy, Kim Hunter, Tony Randall, and Lee Grant; J. Frank Dobie; Ed Sullivan, David Susskind, and Mark Goodson. But the hero is Faulk himself, a man who--in the words of Studs Terkel--"faced the bastards and beat them down."

5.0 out of 5 stars "Fear on Trial" should not be forgotten, May 21, 2000

This review is from: Fear on Trial (Paperback)
John Henry Faulk was in an up and coming radio and TV personality when in the mid 1950s when he decided to stand up to those who tried to turn America against itself. His memoir of his legal struggle, "Fear on Trial" tells how he was blacklisted by AWARE, Inc. and subsequently could not work in his chosen profession. Mr. Faulk, with the help of such prominent broadcasters as Edward R. Murrow, Charles Collingwood and Mark Goodsen, hired famed cousel Louis Nizer to file a lasuit against the blacklisters. His victory sounded the death knell fr those who would try to rule through fear, intimidation and innuendo. "Fear on Trial" is a must read for all those who value freedom if thought and expression, for if it were not for John Henry Faulk, Howard Stern, Don Imus and Rush Limbaugh and others would not have the freedom they do today. His writing style is the same as his broadcasting tyle was, simple, folksyand to the point. His recalling the terrible days of unemploable status and the help of friends such as Tony Randall, Jack Gilford (also blacklisted) and others will tug at your heart, mind and soul. I most heartily recommend this book.

5.0 out of 5 stars Those who do not study history...., February 18, 2006
By

... are doomed to repeat it. And no book captures more vividly the history of the McCarthy hearings then this book. Anyone hearing McCarthy's words today, from his general classifications of all americans into either loyal citizens (supporting him) or enemies of the state (the rest), to his labeling the International Workers of the World a terrorist organization, should find them hauntingly current and familiar.

A must read for anyone who truyly values democracy, liberty and the *real* America-- the one where difference of opinion is valued, not feared.

I had never heard of John Henry Faulk prior to coming across a mention of him and this book by Studs Terkel. After reading this book, I strongly suspect he would have been as well-known as Johnny Carson. He tells his story so well with just the right amount of detail and citing transcripts from the trial. While I knew about black-listing, I had no idea of how devastating it was, how powerless they were (condemned based on what was often flimsy or inaccurate evidence, often without knowing why or having a chance to defend themselves) and how these self-righteous people could accuse anyone they chose with impunity. He also gave me a much greater appreciation of what the best lawyers need to do to prepare for a case. He was a man of rare courage and conviction.
