1) The United States (i.e. Federal Government) has limited jurisdiction. As stated in Article 1, Section 8, Clause 17 of the Constitution for the United States of America:

I bought this book when it first came out and while Schiff gives a lot of information on the subject of federal income taxes, he missed some very important information.

1) The United States (i.e. Federal Government) has limited jurisdiction. As stated in Article 1, Section 8, Clause 17 of the Constitution for the United States of America:

"To exercise exclusive Legislation in all Cases whatsoever, over such District (not exceeding ten Miles square) as may, byCession of particular States, and the Acceptance of Congress, become the Seat of the Government of the United States, and to exercise like Authority over all Places purchased by the Consent of the Legislature of the State in which the Same shall be, for the Erection of Forts, Magazines, Arsenals, dock-Yards, and other needful Buildings;"

In other words the United States Congress can only pass laws that apply within the above defined areas. Since Schiff is big on case law here's one that he missed:

"The power of the United States to tax is limited to persons, property, and business within their jurisdiction, as much as that of a state is limited to the same subjects within its jurisdiction."

- United States v. Erie Ry. Co., 106 U.S. 327, 333, 1 S.Ct. 223 (1882)

26 USC § 7701(9) defines the "United States" as the District of Columbia and the several states. At § 7701(10) the term "State" is defined as the "District of Columbia". Did you get that or did you miss it? The 50 union states aren't included in those definitions. See 26 USC §§ 5272(b), 5362(c)(9), 6103(b)(5), and 7462 for code sections that include the union states.

Jurisdiction should have been his MAIN argument.

The "Dixieland Law Journal" some excellent information on the subject of federal jurisdiction. Do a web search with those key words.

2) The Internal Revenue Service is NOT a agency on the United States! Look at 31 USC §§ 301 thru 310. Every agency of the Department of the Treasury is listed therein. Notice that the IRS, BATF, and Secret Service are NOT listed!!!

For the most detailed information about the origin of the IRS search the web for the document "THE BIGGEST HEIST IN HISTORY" by William Cooper.

3) ON the subject of wage withholding he never informs the reader about the following points:

a) 26 USC § 3402(p) which clearly states that the W-4 form is voluntary. Read it for yourself. If it's voluntary why does he advise you to fill it out and claim "exempt"?

b) He never informs the reader of the legal definition of employee as defined in 26 USC § 3401(c). He never discusses the legal meaning of the word "includes" as used in the code. It is meant to be used in a restrictive manner. In other words "employee" includes only the definitions in that code section! If it's not included it's not a part of the definition! Are you an "employee"? If you're not why does he advise you to claim "exempt" on a W-4?

c) He missed the definition of "Withholding Agent" at § 7701(16). That is very important. That definition contains the withholding requirements in the IRC. Look them up and see if you are subject to it.

4) He never researched the Code of Federal Regulations (CFR's). The CFR's have more detailed information than the IRC. If you carefully study the sections that apply to Subtitle A, you'll notice that the sections that define "United States" don't include the 50 union states!

I could go on but I won't. Irwin Schiff has done a great deal of research on this subject and I thank him for it. Because of him I've saved a lot of cash. However, If you think that by reading this book (or any of his other books) that you'll know every thing about the US income tax, you are mistaken. There is a lot of valuable information out there that Schiff has NEVER covered. Get on your favorite search engine and start looking for it! I've found it and so can you!

Here's a list of some documents that will help you figure out this complex subject. Search the web for them.

1) "PUBLIC JUDICIAL NOTICE" by William Cooper. There are 3 parts of this document. Read them all! Very good information in these!

2) "AN INVESTIGATION INTO THE MEANING OF THE TERM UNITED STATES", by unknown. This is a long and detailed document that is a must read!

I would also suggest that you purchase the book "GOOD-BYE APRIL 15TH!", BY Boston T. Party. I would recommend this book over any of Schiff's books. Read it!

This book is the most accurate and referenced accumulation research on the history of income taxes. Starting with the Federalist debates elaborating on the inclusion of all the taxing clauses written in the constitution. You will learn there was a very strong opposition to the federal government having any taxing powers at all!! The only reason it was reluctantly decided to grant the federal government any taxing powers at all was to allow the government to have quick access to capital ONLY in times of war (not our failing social handouts)! You will understand the brilliant constitutional safeguards that the founders of our constitution devised (apportionment on direct taxes) to the potential abuse that they foresaw (our current tax system). Follow the Supreme Court decisions that are ignored in our current courts from the Pollock case (reversing previous Supreme Court cases on the definition of direct taxes) to the Brushaber case (that held that the 16th Ammendment did not add any new taxing powers to the constitution). In essence the 16th amendment did not amend the constitution! Learn why the income tax is a masterful hoax. 1) its not income its a CORPORATE PROFIT!! 2) Its not a tax its a VOLUNTARY CONFESION!!! This book should be mandatory reading in every law school in America!!!

This book is incredible and so very well documented that you can't possibly ignore it if you truly value your freedom as an American. Make this book mandatory for every law student and CPA in the country, and maybe then they can get back to doing what they should be doing all along: protecting our freedoms instead of living off our backs and our misfortunes.

I have a friend who is in the early stages of disputing the IRS-Seems Scary. I believe that everything Mr. Schiff writes about is 100% true, but has anyone out there done this and succeeded? If so, how many years? We need to hear more success stories on these review forums. If people who succeed at this would get the word out, maybe a greater population would do it.

Very carefully piecing together the history of this so-called income tax, Mr. Schiff shows why the IRS regularly lies and deceives the citizens of the United States into paying a tax that they aren't liable for.

Using the Internal Revenue Services own Code, Mr. Schiff points out the far too numerous times that the very law is broken by the IRS.

More importantly are the United States Supreme Court cases that firmly establish the income tax as nothing more then a Constitutional version of the Corporate Tax of 1909. Why these Supreme Court decisions are ignored (although thanks to men like Mr. Schiff, more and more Americans are aware of these decisions) by lower Federal Courts is the greatest crime in American history.

Other books by Mr. Schiff are also recommended and hopefully Amazon.com will carry them as well. Of particular interest is "The Federal Mafia" and Mr. Schiff's audio tapes.

All are a must for lovers of freedom & liberty!

Before you get too enthused with Mr. Schiff's books, you should know that Schiff is serving a 13-plus year sentence for tax crimes (with his location listed as the Terre Haute Federal Correction Institute as of April, 2009). His projected release date is 7 October 2016. He has lost several civil cases against the federal government and has a record of multiple convictions for various federal tax crimes. Before you believe anything in any of his books, talk to a licensed tax attorney.

I think Irwin is fantastic!! Everyone of his books are worth getting!!! Get this book now....you will save tons of money and really get an education as to how you are getting screwed by your government misapplying the law!

The law says you don't have to pay....so stop paying now!!

Buy this book and Irwin's other books (ESPECIALLY The Federal Mafia) to find out how.....I've followed Irwin's procedures for 3 years now...He's the best...forget the rest....I've researched this for over 5 years now....more people use Irwin's method's than any other and that's for good reason....

Unfortunately, the income tax has been well-litigated. It is a point of law well-settled. The courts will not revisit the constitutionality of the law. It is a given. It is like a patient arguing that germs do not exist and he need not wash his hands until you prove otherwise. Typhoid Mary was imprisoned for life because she insisted upon being a cook in which she would spread the deadly typhoid germs. That is why Irwin Schiff was given short shift when he attempted to try to prove this law, the income tax, was unconstitutional.

Irwin Schiff is the poster child for self-martyrdom that the income tax should not be paid. He keeps boasting on website that he has proved his case in court wherein reality he has repeated convicted and served jail time. When an interviewer asked: "But you went to jail for four months and paid a $10,000 fine. So in essence, haven't you really paid your federal income taxes for those years that you didn't file?" Schiff in denial responded: "No. No. No, no. That was a fine, and I'm going to be getting that back. We'll be suing the government." "Paying taxes is the price of citizenship. After three strikes, I would hope that even Schiff realizes that he has struck out," said Internal Revenue Service Commissioner Mark Everson.


While putting up a website repeating these false claims, Schiff has also appealed his conviction that he is "crazy." Schiff is serving a 13-plus year sentence for tax crimes (with his location listed as the Terre Haute Federal Correction Institute as of April 21, 2009). His projected release date is 7 October 2016. Somehow Congress has ignored Schiff`s claim that it repealed the income tax in 1954! Schiff's attorneys asked that the court consider the claim that Schiff has a mental disorder relating to his beliefs about taxes. At this point, he does time while his appeals are rejected.

Wesley Snipes is the latest to discover that nobody wants to revisit whether or not the income tax is constitutional or not because it is a settled issue. In his case, he is out on bail while appealing his case. He will be sent to jail like other tax protestors who futilely claim they need not pay federal income taxes. A constitutional amendment passed during the William Howard Taft Administration gave Woodrow Wilson the opportunity to pass the income tax. Of course, this 1% tax has morphed into a tax on the middle class. Uncle Sam finds this is a wonderful opportunity to get additional income through fines and penalties. The only way to get rid of the income tax is not earn enoug income to qualify, get Congress to repeal it, or get a Constitutional Amendment. Meanwhile pay your income taxes unless you like the comforts of jail!

I met Mr. Schiff in 1996, purchased this book, and have practiced many of the researches he provided. I rank it a 3 star only because his new book the Federal Mafia would be a 10 star book in further research. The review by trader100 should rightfully be called TRAITOR100... because he is one of the sheeple thinking the government that has screwed all Americans since the illegal imposition of a constitutional amendment that was NEVER passed is going to FIX? a system they benefit and profit from! Big Brother will take care of him... hahahaha.. Mr. Schiff's time in jail was NOTHING more than being a political prisoner to shut him up...same as LaRouche...

I highly recommend this book and Mr. Schiff's research to any true researcher of truth and facts. If we all continue to think as sheeple, like trader100, then we deserve being LIED to and SCREWED at every whim of our Big Brother Masters.

This is a great book (although the examples of how numerous judges simply ignore the constitution and the law are infuriating). I gave it a 4 instead of a 5 because some of the legal arguments are difficult to follow (and the government has purposely obfiscated things enough to make it this way). The review by Mr. Trader100 indicates to me that he is the kind of person who would discourage the Boston Tea Party and urge everyone to "work within the system" and beg your English colonial governor for reform. Each man has to decide for himself where to draw the line.
