Book Description

September 2002 0198765746 978-0198765745 2nd
The second edition of this well established textbook provides a readable, comprehensive and accessible account of the law governing health care in England and Wales. In contrast to other texts, it examines the full range of health care, but not merely its medical context. The narrative is clear and succinct with full references to legal sources to meet the needs of law students and practitioners. However, excessive use of legal jargon is avoided ensuring that the law is also accessible to health care professionals. The text sets out the law on public health, the NHS, the health professions, clinical negligence litigation, patients' rights, and research and health care ethics. Major developments since 1997 have led to substantial revisions throughout the book, which now takes account of such organisations as the National Institute for Clinical Excellence and the Commission for Health Improvement. Professor Montgomery addresses the legal and regulatory responses to a series of 'scandals' (Bristol babies, Alder Hey etc); the development of medical techniques and regulatory bodies; the impact of the Human Rights Act and the Data Protection Act; the Blair administration and NHS reforms.

Editorial Reviews

Review

`Review from previous edition It is refreshing to find a text that states the law clearly, comprehensively, and accurately in a form that is easily digested by educated non-lawyers. Jonathan Montgomery's book achieves his stated aim of providing those who work in the health service with a detailed survey of the legal context of their work...the book is an excellent and wide-ranging review of medical law that should prove invaluable for members of the medical professions.'' British Medical Journal September 1997

`'He clarifies the complexity of legislation, case-law, and quasi-law affecting the National Health Service. He describes and discusses with refreshing lucidity the range of areas traditionally covered in medical law texts..."Health Care Law" maps the terrain and trends well. It is thorough, informed, and wide-ranging presentation and commentary on most aspects of English law regarding health care and medicine. Montgomery achieves his objective of explaining the law clearly to an intended audience of lawyers, and students or practitioners of medicine and other health-care professions.'' The Lancet
