The book addresses the current issue of the applicability and application of international human rights law and international humanitarian law in times of armed conflict. Scholars chronologically argued that only international humanitarian law was applicable, that both legal regimes were applicable, and eventually that international humanitarian law was the lex specialis of human rights law. The most recent trend, supported by the research carried out in this book, shows that international humanitarian law and human rights law are slowly merging into a single set of rules. The book examines general issues relating to applicability and the implementation of the two legal regimes as well as provides case studies focusing on specific rights or persons.

About the Author

Roberta Arnold, Ph.D. (Bern) LLM (Nottingham). A former legal adviser to the Swiss Dept. of Defence, she is currently a barrister trainee with Riva & Felder Solicitors (Lugano, CH) and a candidate investigating magistrate within the Swiss Military Justice. She authored, among others, The ICC As a New Instrument for the Repression of Terrorism (Transnational Publishers, 2004), winner of the Francis Lieber Honorable Mention Award and the Walther Hug Prize.Noelle N.R. Quenivet, Ph.D. (2004) in Law, University of Essex, is Senior Lecturer at the University of the West of England. She has published several articles relating to international humanitarian law and the use of force as well as authored Sexual Offences in Armed Conflict and International Law (Transnational Publishers, 2005), winner of the Francis Lieber Honorable Mention Award.
