The facts? Well.. the facts are that there is already a thread on this and that it is a load of crap from some ignorant paranoid twit online. The facts are that the EULA has always stated that they monitor all activity on Live, that MS has always monitored public Live activity live (with people who go in and join public games to monitor them), that MS as always kept tabs on (and stored) all activity on Live both public and private for the purposes of being able to handle complaints accurately, and that MS has been up front and very public about the fact that it does all of this. Christ, the head of the deparment that does this, Stephen Toulouse (AKA Stepto), goes out and makes public appearances at places like PAX and wOOtstock to talk about their monitoring as well as covers it on twitter and his blog and on Major Nelson's podcast. OH.. and lets not forget the fact that this paranoid conspiracy crap came up back when the camera was first released as well. Or the fact that the policy team sees enough life scaring crap done by idiots on Live when monitoring public channels (helicopter anyone) so they wouldn't want (or have the time) to go and see the crap people do at home as well. All they care about is what people do on their servers, on their service, in order to protect the company and the users from the nasty crap some idiots do online. Or the fact that the moron running that blog says that violating a TOS/EULA is "illegal"... LOL!! The best and worst thing about the internet is that it lets morons like that spew their ignorant garbage for the world to see. (well.. OK.. there are far worse things out there on the net...)
So yes, it is good to know the real facts.. before blindly believing all the crap spewed around on the internet by random ignorant paranoid fools.

Or you just unplug it when you aren't using it...right? It doesn't have to be plugged in all the time, does it? The same thing could be said for a webcam...maybe all webcam makers have been spying on people all these years...

You actually think that a person who wants to know the real facts, who goes out an researchs the real facts, who rejects the notions of blindly believing everything they read on the internet just becasue it matches their personal beliefs is the one who is ignorant? Over 8 years now. That's how long MS has been monitoring all Live activity. 8 years now. That is how long this has been in the EULA. 8 years now and not one hacker or security expert has ever seen any issue of, or capability for, MS to look into and see what you are doing on your personal Xbox or listened in on anyone through the mic when you are not actively using the Live servers in some online service (games, chatting, messaging). 4 years. That's how long MS has had the vision camera. 4 years now and not one hacker or security expert has ever seen any issue of, or capability for, MS to look into and see what you are doing through your Live Vision Camera when you are not actively using the Live servers in some online service (games, chatting, messaging). And in all this time.. all these 8 years... MS has been upfront, public and vocal about thhe fact that they monitor all Live activities through their servers. (more vocal in the past few years than before though)
So like I said.... ignore the facts, don't bother with researching the truth, blindly believe a random blogger on the net.. and stay happy.

Seriously, show me a license agreement for any communications service that does not allow the provider to monitor how you use the service? Just so you know, Facebook can see what you post, your email provider can turn over your logs to law enforcement, your ISP can see what you've been doing, your cell phone carrier knows exactly where your phone is and your GPS equipped car can be used to determine your location.

The are a few programs that can be ran to hijack a web cam, even to the point of turning it on remotely, funny thing, I learned about this YEARS ago. I would suggest to anyone who is paranoid to A.) Unplug the unit when not in use B.) Get a web cam that has a light when it is transmitting. (For the web cam related discussion) Simple fixes for those who still don't feel secure after the all of the explanations on this thread C.) Just don't buy one! Easy enough. I love my kinect, yes the red light creeps me out when it's still on for 10 minutes after I start playing Fallout in my bra and boy shorts, even though I know better, however it was a choice to have it in my home. XD

Personally, I think I am a little too boring for anyone to spy on, but when the ability exists, there is also the potential for abuse. I don't think MS has the incentive or the resources to monitor people on a large scale, but what if your ex works for them and decides to keep tabs on you? Or if you have a teenage daughter with one in her bedroom? It is best to be aware of the issue and take the steps to protect yourself.
This would have been a great episode of the Saprano's...the FEDS spying on them through Anthony Jr's XBox...lol.
