This is not a hands-on, how-to book, January 20, 2007

For anyone wishing to get a better understanding of the big picture involved with mediation and arbitration, specifically in the realm of employment disputes, then this book is very helpful. If you are looking for a hands-on guide to help you learn to mediate or arbitrate, then this would not be the book for you. This book is not without merit, but the potential reader needs to think about what he or she needs.
The authors walk the reader through the arbitration and mediation movement in business and government. They discuss the case law behind it (in which the courts agreed to honor the findings of arbitration) as well as the legislation that is geared towards empowering this movement. A reader of this book would have a firm understanding of the organizations involved as well as the important cases and documents (like the Protocol).
The book was interesting in watching the change and resistance. Seeing a true alternative to expensive, prolonged litigation is hopeful, yet the authors aren't merely painting an overly rosy picture. They do point out the resistance and the possible trouble (such as problems of due process).
Even though the book was not what I originally thought, it was a good read as I found the progress of this movement interesting. However, if you are looking for a how-to book, then this one will not get you where you need to go.
