Book Description

Actions concerning medical negligence have increased dramatically over the last decade. Those actions concerning the head, spine and nervous system form a significant part of these cases and damages are usually substantial. Problems generally arise not because of negligence on the part of neurologists or neurosurgeons, but because non-specialist staff fail to identify the correct diagnosis.

This new book concentrates on the areas that tend to lead to litigation, bringing together clinical specialists with experience as expert witnesses. The legal aspect is highlighted by a leading barrister and solicitor in the field of medical negligence.

Editorial Reviews

Review

"This is a real medico-legal book. It is about avoiding litigation.
A dozen front rank medical experts expound good practice within their speciality, and Bertie Leigh, a leading solicitor with immense experience in these cases gives an expert legal commentary.
Good practice is the key to avoiding litigation. Good practice is here expounded with experience and authority and lucidity and clarity and simplicity."
--Alec Samuels, (Medico-Legal Journal, 1999)

From the Back Cover

Actions for medical negligence have increased dramatically over the last decade, and settlements may be very substantial when damage to the nervous system is the result of errors in diagnosis or treatment.

This book discusses clinical situations in which errors in diagnosis or treatment have led to litigation on account of damage to the skull, spine or nervous system. The book opens with a introduction on the law by leading counsel and a number of the subsequent chapters include a legal commentary by a solicitor. Both lawyers have wide experience in this field.

Many nervous system problems which have given rise to legal action have occurred in areas of practice other than neurology and neurosurgery, but opinions from neurologists or neurosurgeons are often needed in the course of the litigation. In some cases neurological specialist are directly involved. the subjects discussed are dealt with in the light of the experience of the authors, all of whom have had considerable experience of advising in cases of this sort.

The book will be of particular use to lawyers practising in the field of medical negligence as well as t hospital managers and their risk-assessment units. Neurologists and neurosurgeons in their clinical practice, and when acting as expert witnesses, will welcome the legal commentary.
