Book Description

July 2, 1992
This partial summary of the ten-volume Report of the Commission of Inquiry on the Rehabilitation of Phosphate Lands in Nauru covers the responsibilities of various powers which controlled Nauru, from 1906--when phosphate mining began--to the island's independence. It also discusses the feasibility and execution of land rehabilitation. Weeramantry examines a number of facets related to international law--mandate and trusteeship, environmental law, abuse of power, unjust enrichment, acquired rights and permanent sovereignty over national resources. Probably the most detailed practical study of an international mandate and trusteeship ever conducted, the importance of these issues gives this work a significance reaching far beyond Nauru itself.

Editorial Reviews

Review

"A comprehensive review of the history of Nauru's phosphate industry, exploring the detalils of mining agreements, international negotiations and obligations, the relevant aspects of international law, and the role of the United Nations."--The Contemporary Pacific

"A sensible and sobering overview of international responsibility for what transpired in Nauru. Anyone interested in international environmental law, sensible concern and care of natural resources, and questions of sovereignty in such matters will find this book useful. Also, its ramifications extend far beyond the limited boundaries of Nauru."--Choice

"In the context of global concern about environmental issues and the heightened attention to the application of international law to the protection of the world's environment, this is a timely book. Clearly it is written by an authoritative author....Australians who have a view of their country as a model international citizen, entitled to expound human rights to all and sundry, will be chastened by a reading of this book. It deserves a wide readership in Australia and beyond."--The Age (Melbourne)

"This fine study....is a microcosm of our time. It raises some of the most fundamental legal and political issues of the late twentieth century."--The International Lawyer
