Book Description

August 1, 2001
It was bad enough when popular offensive line coach Joe Moore sued the University of Notre Dame for age discrimination—but matters got much worse when the lawsuit uncovered disquieting evidence of unethical and inappropriate conduct in a football program widely regarded as a model of probity.

This is the dramatic story of that explosive lawsuit, which tarnished Notre Dame’s burnished football image: the winner of eleven national titles; the home of legends Knute Rockne, the Gipper and the Four Horsemen; the subject of innumerable books and films—Notre Dame football has been idealized as everything that is good and right about American sports competition and, indeed, about America itself.

This riveting story begins in November 1996, when Bob Davie is hired as head coach to replace the beloved Lou Holtz. In one of his first—and most fateful—executive decisions, Davie fires 64-year-old Joe Moore because—as Davie puts it—he needs someone younger for the job.

Attorney Rick Lieberman takes on Joe Moore’s case and in this absorbing book he describes the trial and the enormous tensions to which litigants like Joe Moore are subject. This is a David and Goliath story in which the Notre Dame attorneys attempt to destroy Joe Moore’s reputation as both a coach and a man. In the process, Davie’s own background comes under close scrutiny as a reporter’s investigation reveals some damning evidence.

And as the trial proceeds, Notre Dame’s football program is shown to be rife with legal improprieties and inappropriate behavior involving both coaches and administrators.

Anyone interested in sports, in the law, in stories of blatant injustice—and in Notre Dame—will find Personal Foul a fascinating, revealing and memorable read.

Editorial Reviews

From Publishers Weekly

When Bob Davie took over the high-profile Notre Dame football program at the end of the 1996 season, he fired his predecessor's esteemed, long-time offensive line coach, Joe Moore. Though Davie was free to choose any coach he wanted, he specifically cited Moore's age 64 as a factor in the decision. After further disrespect from Davie and the university, Moore decided to sue Notre Dame for age discrimination. Lieberman was Moore's lead attorney; his book is a no-frills account of the lawsuit. His personal regard for the coach helped his efforts in the courtroom, but it doesn't help his book: he puts Moore on a pedestal and ends up writing a one-sided story. ("Honesty more than any other virtue mattered to Joe," he gushes.) The book is intriguing for its close look at the suit and at Lieberman's own legal stratagems (including his choice of courtroom clothes that would contrast with the duds of Notre Dame's legal team, curry favor with the jury and play upon what he hoped were its blue-collar sympathies). The book includes some embarrassing revelations about Davie's past and about the conduct of some Notre Dame students, but few tidbits emerge that have not already been widely reported. While Lieberman does an adequate job of telling his side of the story, his is hardly a complete or impartial perspective on the case. B&w photos not seen by PW. (Aug.)Forecast: A good legal drama is hard to resist and Notre Dame's football fame should help sell this one, though a September beginning of football season release would have made more commercial sense.

From Library Journal

Joe Moore, offensive line coach for the University of Notre Dame football team for nine years, was fired from his position after the hiring of a new head coach. Moore, who was 64 at the time, contended that age discrimination was the principle reason for the dismissal, and he sued the university for financial damages and to get his job back. Here, Moore's attorney chronicles the case, guiding the reader through the ugly pretrial and trial processes and showing a side of Notre Dame few people witness. Unfair hiring practices are only the tip of the iceberg as Lieberman reveals a storied football program rife with ethical problems in the hiring of its coaches and the treatment of some of the players themselves. The book is biased in that it shows the progression of the trial only through the author's eyes, but it does ably demonstrate how an actual trial case is conducted and the unexpected costs to both sides. 5.0 out of 5 stars ...Bob Davie ..., October 18, 2002

This review is from: Personal Foul: Coach Joe Moore vs. The University of Notre Dame (Hardcover)
... Coach Moore is a simple and straightforward man who was thrown under the bus by his friend Davie after Davie maneuvered his former head coach Lou Holtz in front of that same bus. The reader learns of Davie's scandal ridden past and how the University looked the other way and even used its power to fight Coach Moore despite being totally in the wrong. ... An enlightening look at the dark side of an egomaniac...and an instiutution...that backed him.

5.0 out of 5 stars The true story of a volatile lawsuit, March 26, 2002
This review is from: Personal Foul: Coach Joe Moore vs. The University of Notre Dame (Hardcover)
Personal Foul: Coach Joe Moore vs. The University Of Notre Dame by Richard Lieberman is the true story of a volatile lawsuit that coach Joe Moore filed against the University of Notre Dame for age discrimination. From this suit came evidence of pervasive unethical conduct in a university football program that had formerly been given the highest regard. Commanding the reader's full attention, Personal Foul is a compelling and revealing exposé into the tangled and often dark complexity of human nature in general, and college football in particular. Highly recommended reading for college football fans in general, and University of Notre Dame alumni in particular.

5.0 out of 5 stars A worthwhile read, October 3, 2001

This review is from: Personal Foul: Coach Joe Moore vs. The University of Notre Dame (Hardcover)
A very well written book that is hard to put down. Joe Moore is a fascinating character, and the book reveals both the intricacies of litigating an age discrimination case and a behind the scenes look at the Notre Dame football program.
