This revised and updated edition of The Rights of Employees and Union Members is actually two books in one, combining two earlier ACLU handbooks, one dealing with the rights of employees and the other with the rights of union members. Utilizing a simple question-and-answer format, the authors examine in detail such topics as the employment relationship, compensation and benefits, discrimination (including discrimination based on race, ethnicity, sex, religion, age, disability, AIDS, sexual orientation, and veteran and reservist status), the union workplace, and workplace protections. The handbook provides particularly relevant information regarding the hiring process, the right to privacy, and disability discrimination and includes appendixes on federal antireprisal statutes and legal resources for employees.

Written for every working American, this book sets forth individual rights under present law and offers suggestions on how citizens can take steps to protect themselves. Like others in the series, this volume was developed in the hope that Americans, informed of their rights, will be encouraged to exercise them.

Robert J. Rabin is a labor arbitrator and mediator who teaches at the Syracuse University College of Law.

Lisa R. Lipman is in private practice in New York City, where she specializes in representing employees in employment matters.

As the ACLU points out, "The Constitution does not apply to the private sector.....(but) People should not have to hang up the Bill of Rights at the time clock or the office door. Employees are not pieces of equipment. Treating them with dignity and fairness is not inconsistent with good, competitive, management." ( http://www.aclu.org/issues/worker/iswr.html)

Lots of luck convincing your boss that you should not ,for example, be required to answer incriminating questions. Lots of luck with discussions of due process , hearsay evidence at hearings, etc., etc., ad nauseam. My boss just doesn't get it. He says "The next thing you'll want is to elect bosses." Good idea, but its time has not yet come; however it would simplify things immensely if we were looking at a system of justice at work that was similar to what we see outside in REAL life. Isn't the pay you earn as real a "property" as any other? No one should be deprived of life, liberty, or property without due process of law, even at work.

This ACLU handbook may help. It covers, in question and answer form, what meager rights one does have in everything from hiring, to discipline and termination. After you (and your boss?) read it let's try to get together and "revolutionize" workplace justice.<HTML
