Alternate dispute resolution (ADR) is a means by which business and personal conflicts may be settled with less cost and aggravation than going to court. ADR may involve negotiation (parties thrash out a settlement on their own), mediation (an impartial mediator helps those in the disagreement work things out), or arbitration (a neutral third party renders a final decision after hearing from the opposing parties). This book looks at the nature of disputes and the human reasons why they occur and why they are often difficult to resolve. Crowley, an attorney experienced in ADR, suggests that, by ritualizing the resolution process, the nature of the conflict is changed and the remedies can be engineered. He walks readers through the theory and practice of each component of ADR and peppers the writing with anecdotes and references to popular culture. The result is a well-rounded primer on an important new trend. Highly recommended for public libraries.
