In 1992, the voters of Colorado passed a ballot initiative amending the state constitution to prevent the state or any local government from adopting any law or policy that protected a person with a homosexual, lesbian, or bisexual orientation from discrimination. This amendment was immediately challenged in the courts as a denial of equal protection of the laws under the United States Constitution. This litigation ultimately led to a landmark decision by the United States Supreme Court invalidating the Colorado ballot initiative. Suzanne Goldberg, an attorney involved in the case from the beginning on behalf of the Lambda Legal Defense and Education Fund, and Lisa Keen, a journalist who covered the initiative campaign and litigation, tell the story of this case, providing an inside view of this complex and important litigation.
Starting with the background of the initiative, the authors tell us about the debates over strategy, the court proceedings, and the impact of each stage of the litigation on the parties involved. On November 3, 1992, a majority of Colorado voters approved Amendment 2, a measure placed on the ballot by the right-wing religious group Colorado for Family Values, amending the state constitution to allow "no protected status based on homosexual, lesbian or bisexual orientation." A lawsuit was immediately filed against the initiative, and the ensuing legal battle provides a fascinating look at the political process in the ongoing cultural wars. Keen, an executive editor for the Washington Blade, and Goldberg, a member of the legal team challenging Amendment 2 on behalf of the Lambda Legal Defense and Education Fund, clearly and carefully chronicle the background, strategies, proceedings, and arguments of the case, which became known as Romer v. Evans. Ultimately, the U.S. Supreme Court ruled the measure unconstitutional, temporarily tempering growing support for copycat measures across the country and reasserting the constitutional promise of democracy and liberty for all. Suzanne Goldberg, the Lambda Legal Defense Fund attorney who worked on Romer v. Evans, and Lisa Keen, the Washington Blade journalist who won an award from the A.B.A. for her news coverage of the case, have collaborated on a truly fascinating "inside baseball" account of the litigation. Particulary useful: their detailed description of the expert testimony offered to the trial court on the issue of "suspect classification" for sexual orientation discrimination analysis. This is a must read for lawyers and legal scholars interested in Romer and gay rights generally.

I loved this book. A very readable journey through the court case which arose out of Colorado's anti-gay initiative, supported by a clear and descriptive primer on the larger gay rights movement. The pacing was crisp, the writing clear and the story told in a compelling fashion. I highly recommend this book.
