CASE FACTS: Jeantta Pearson suffers from Multiple Sclerosis and paralysis. At age 47 ,she became a patient under the care of Heritage Gardens Healthcare Center (Heritage), a nursing home. Her care consisted of total medical care and assistance with all activities of daily living. Heritage cared for her from September 2002, until November 2004. In November 2004, Pearson was admitted to Trinity Medical Center Hospital with a severe flare-up of chronic urinary tract infection (UTI), and alleged that this episode and its attendant medical expenses, . pain, and suffering were caused by Heritage's negligent failure to provide proper care in monitoring and treating her urinary tract catheter.
