Format: Hardcover
This is an exceptional casebook that reads like a virtual law class. The text is compelling and accessible -- even humorous where appropriate; it is an ideal text for a first-year class. Twerski and Henderson make the case that tort law deals with people and what people do to each other, as well as with how the law can or cannot make them whole. The Authors have included 'dialogue boxes' in which they argue about the outcome of cases, and the fairness of the results. These dialogues introduce the first year law student to the Socratic method, while clarifying the different viewpoints on the finer points of tort law. The text encourages the reader to question results and assumptions, distinguishing settled law from murkier issues. The text de-mystifies basic tort concepts such as duty and proximate cause, within the context of classic cases, outliers, and the development of the three Restatements. The Authors, who were reporters for the 3rd Restatement, have managed to document the common law as it stands throughout the States, including enough reference to assist any student's research, but without turning the text into a dry, extended bibliography.
