Book Description

June 1998

Your ability to reconstruct or litigate a train accident can mean the difference between a successful or failed case. However, even experienced reconstructionists and attorneys are often unfamiliar with the myriad complexities of railroad operations and trains. Now, whether you are a novice or an experienced litigator, you can access a wealth of information in this ground-breaking text. In fact, much of the data and formulae are available here exclusively, saving you hours of tedious calculations and research.

Now in its fourth edition, this book is one of the most comprehensive texts in the field of railroad accidents. It contains a new section on remote control locomotive operations (RCL) and remote control operators (RCO), and helps you answer the question, is the "black box" and "appurtenance" causing strict liability under the Locomotive Inspection Act? The book also has updated information on grade crossing litigation, Americans with Disabilities Act, and federal pre-emption versus federal preclusion in FELA cases (an area in which many attorneys and courts err). With a subject as demanding and complex as train accidents, this book is an important tool to have on your side.
Topics Include: • remote control operations • event recorder analysis • FELA negligence claims • locomotive, railroad car, and RR track design • grade-crossing design, performance, and litigation • patron or employee slips, trips, and falls • audibility and visual issues at rail-highway grade crossings • derailments • demonstrative evidence in railroad litigation • forensic analysis of train collisions • locomotive cab safety and crashworthiness • breaking system design and performance • motor vehicle and human factors • speed, time, and distance calculations • pedestrian Accidents • Americans with Disabilities Act • third party liability issues • FELA compensation and benefits

Review

By: Pamela R. O'Dwyer,   -  January 15, 1997

Books like Train Accident Reconstruction and FELA & Railroad Litigation form the building blocks of our railroad cases. From brakes to wigwags, it's all covered. No attorney who is thinking of handling his first crossing case or a case under the FELA should be without this primer.

By: David A. Meyer,  Minnesota Trial Lawyer Magazine -  January 1, 1996

To anyone either practicing in this area, or with an occasional case involving railroad accidents and injuries, I strongly recommend adding this book to your library.

Reference and Research Book News -  February 1, 2006

Of use to engineers, attorneys, law enforcement, private consultants, and railroad personnel, this text describes in detail the technical and legal issues that concern railroads and trains that apply to train collisions and FELA cases. This review is from: Train Accident Reconstruction and Fela & Railroad Litigation (Hardcover)
This is an excellent reference book for railroad safety experts and attorneys who are interested in understanding the dynamics and laws applying to railroad accidents. It should also serve to enlighten attorneys of the need to employee railroad accident and safety specialists early on in the process when dealing with these complex issues . There is much information that is needed early in discovery that could other wise be lost if it's not named.
