Yes. The E2D Defender comes with two (2) CR123 batteries included, but I also recommend buying a 12-pack of Surefire batteries from Amazon. I haven't found the batteries cheaper anywhere else.

Yes, I believe it is waterproof, but I would not know at what depth the pressure would get to it - since it isn't built specifically for diving, the light might start to leak under high water pressure. It might hold up, but am not sure.

Not that I've seen Larry. Always bright first then dim if you press again within about a second. If you wait longer it's bright again. Fantastic light
