CONTEMPORARY PERSPECTIVES ON MILITARY OPERATIONS AND THE LAW

It is reassuring to most and surprising to some, that military operations are heavily regulated. This book, as the authors, Terry Gill and Dieter Fleck, assert, is ‘dedicated to legal advisors in the armed forces on operational deployment, who are charged with interpreting and applying the law under the most difficult and challenging circumstances any international legal practitioner can face.’

The term ‘military’ of course, refers not just to war but to peace and peace keeping. The book therefore covers a broad range of military activities, including those conducted under UN Security Council mandate involving self-defence and humanitarian issues, together with the legal bases and legal regimes applicable to the use of force and treatment of persons involved in such operations.

Published by the Oxford University Press, this is the second edition of a now well established work of reference which provides informed commentary throughout on the diversity of issues pertaining to military operations and concerns that have emerged in the past five to six years since the first edition was published in 2010. These include the targeted killing of specific individuals and cyber warfare.

Interestingly, the co-author of this book, Professor Terry Gill is a member of Expert Group which prepared the ‘Tallinn Manual on Cyber Warfare.
