the argument that it was Consitutional under the Commerce Clause lost 5-4 with Roberts joining in the majority on that argument.
They fell back on the power to tax.

When it first passed, there were a few who said that it was a valid bill under the taxing scheme. If one buys insurance they get a tax break. If they don't they get taxed.

I was surprised this argument was not made by obama's team.

Roberts understood. Give him credit.

The U.S. being the only major industrial economy without mandatory health insurance.

Definitely a huge victory. Not sure how it will play out in the polls. At least Obama won't be damaged by an adverse decision.

If states decide to opt out, Congress can't penalize them.

Millions could still lose out if a large state decides to opt out.

Just shows in the end what the Republicans really want, just like if Roe vs. Wade came up again at the Federal level, one of them (Republican Justices) would have to go out and fall on their sword...

Ohh and if it does look in October like Romney might win the presidency...big pharma will give "huge" contributions to "key Republican Senators"...the Senate is the key...

...maybe Romney could get some cash too, whats so great about two terms as president anyway...
