I can't get too upset about this one. Yes, GameStop should have taken a moment to examine the contents of the memory card but I really wonder if this is worthy of national news. I would have taken a moment to make sure the 3DS works and while I was at it check the memory card as well. I don't think the parents are bad people for not thinking to do this but come on, the father is making this more dramatic than it needs to be. Unless it was midget clowns on swings porn I think that dad can come up with an age appropriate way to explain it. The kid will be fine.

Another legal point in this would be are the parents telling the truth? They themselves could just as easily put those pictures on the 3DS and then make this claim. I would hate if that were true but you do have people out there who are more then willing to do this and far more to get a cash settlement from a business.

If you get any used electronics at a store, check to make sure its working and the memory was wiped before leaving; that should be common sense. You'd be able to get a replacement or not buy if either wasn't done, but after leaving it could be sketchy. This goes double for electronics that you're giving to kids; you never know what it was used for/what was on it before you got it (and seriously, if you're getting this for a kid, or a gift in general, you do not want an old account on it. You just don't) Its just absolutely silly to not check if it was wiped before buying.

I'm blaming the parents more for their negligence here; yes, Gamestop should have wiped the memory, but the parents definitely should have checked before buying, or at the very least before giving it to a kid. And then there is the possibility (which has been said here already) that GS did everything right and the parents set this whole thing up for publicity.

This is my thoughts as well on the subject. Sure I can understand being a little mad over this, I certainly wouldn't want my five year old seeing porn of any type, but to cry like that and act like Christmas was ruined is just ridiculous.

And national news as well? Are you kidding me? This feels like someone is just wanting attention over a rather minor issue.
