Returns and Refunds
Right of withdrawal
The customer can withdraw from the contractual agreement within one month without having to give any reason in writing (e.g. letter, fax, e-mail) or - if the goods have been handed over to the customer before the deadline - by returning the goods. The time-line commences with receipt of this notice in writing, however not before the goods have reached the recipient (with recurrent deliveries of similar goods not before receipt of the first partial delivery) and also not before fulfilment of our duty of disclosure as per Â§ 312c para. 2 BGB (German civil code) in connection with Â§ 1 para. 1, 2 and 4 BGB-InfoV as well as our obligations as per Â§ 312e para. 1 clause 1 BGB in connection with Â§ 3 BGB-InfoV. In the event of a valid withdrawal, the services received by either party shall be returned and any possible accrued benefits (e.g. interest) shall be released. In the event that the customer is partially or wholly unable to return the goods received from us or only be able to do so in a deteriorated condition, the customer shall to this extent, have to provide an according compensation. This shall not apply in the event that the deterioration of the surrendered goods is due to the inspection of the goods as it would have been possible in a shop. The customer will not have to pay a compensation for any deterioration that occurred by using the goods as intended. Goods which can be sent by parcel shipment are to be returned at our risk. The customer is responsible for bearing return shipping costs when the product delivered by the seller complies with the customer's order, when the price of the item to be returned does not exceed a value of 40 Euros, or, in case of a higher value, if the customer has not provided the payment or a partial payment in accordance with the closed contract at the time of the withdrawal. Otherwise, returning the goods is free of charge to the customer. Items not able to be sent by parcel shipment will be collected from the customer. The customer has to fulfil the obligations for the refund of payments within 30 days. 3 Return fees when exercising the right of withdrawal
Â If the customer exercises the right of withdrawal as per Â§ 312d para. 1 clause 1 BGB (German civil code), the customer will have to carry the regular return costs, when the price of the item to be returned does not exceed a value of 40 Euros, or, in case of a higher value, if the customer has not provided the payment or a partial payment, unless the delivered goods do not correspond with the ones ordered. In all other instances, the seller will carry the return costs.Â
4 Prices and payment conditionsÂ
4.1 The prices indicated by the seller are final prices. The sales tax will be indicated, as far as the goods are not subject to differential taxation according to Â§ 25a UStG (German value added tax act). Possible additional delivery and shipping costs are indicated separately in the product description. Further costs accrue in individual cases with cross-border deliveries, for e.g. further taxes and/or duties; for instance in form of custom duties.Â
4.2 With contracts via Amazon the payment is processed via the Amazon Payments system. Payments may be processed via bank transfer (debit) and via credit card. With choosing bank transfer (debit) and providing the bank account data of the customer Amazon is revocable authorised to withdraw the total billing amount from the customer's bank account.
5 Delivery and shipping terms as well as passing on of riskÂ
5.1 The delivery of goods takes place regularly and to the delivery address stipulated by the customer. With processing the transaction, the delivery address stipulated by the customer at the point of the order process is solely decisive.Â
5.2 If a delivery to the customer is not possible, the assigned transportation company will send the goods back to the seller, whereby the customer has to carry the costs of the failed delivery. This does not apply if the failed delivery attempt is not to the account of the customer.Â
6 Title retention
Â The ownership of the delivered goods remains with the seller until full payment has been made.

8 Protection of privacy
8.1 Personal information is only collected, if it is given to us by the customer to fulfil a contract. Without your explicit consent, this information is used only for contract fulfilment and processing purposes based on the customer's inquiries. In terms of future customer care, the data will be stored unless the customer objects this.
8.2 The collected personal information and as far as this is required to deliver the goods, is passed on to the transport company that has been assigned for delivery in accordance to contractual fulfilment requirements.
8.3 Apart from that there will be no passing of the customer's personal information to third parties.
8.4 After complete fulfilment of the contract and payment of the full purchase price, your information is stored in consideration to tax and legal commercial retention periods and deleted after expiry of such periods, as far as you have not explicitly consented to a further use of your information.
8.5 The customer may contact the seller regarding any questions concerning the collection, processing or use of his/her personal data.
9 Information on battery regulation
9.1 Used batteries may not be disposed of in domestic waste. The customer can return used batteries to a communal place of collection or to a local retailer. With the exception of starter batteries, the return of used batteries at communal places of collection is free of charge. Batteries received by the customer from the seller can be returned after use via post at the customer's own expense.
9.2 Batteries containing toxic elements are marked with a symbol of a crossed garbage can. Underneath the garbage can symbol, the chemical description of the toxic waste is found âˆ’ for example Â»CdÂ« for Cadmium. Â»PbÂ« stands for led, Â»HgÂ« for mercury.
10 Applicable law
10.1 The law of the Federal Republic of Germany applies to all legal relations between the parties under exclusion of the laws of the purchasing of international moveable goods. For customers, this choice of law only applies to the extent that the granted protection is not withdrawn by imperative provisions of the law of the country, or state in which the customer normally resides in.
10.2 If the customer is a trader, a legal person under public law or a public special estate, the exclusive place of jurisdiction for any disputes arising out of this contract shall be the location of the registered office of the seller. The same shall apply if the customer has no general place of jurisdiction within Germany, or if bthe place of residence or habitual abode is unknown at the time of initiation of legal proceedings. The authority to call upon a different legal court remains without prejudice.
