Board Certified in Creditors Rights Law by the American Board of Certification, Attorney Mark Wesbrooks details how little known provisions of law assure fairness and justice in Debtor/Creditor transactions, and how the American legal system provides tools and protections that can help to reduce and completely eliminate debt.  America, with all of its ideals, has historically had a legal system that would cater to the powerful at the expense of the powerless. Over time, and through advancement of civil liberties and the hard work of consumer protection advocates, laws have been refined to enable citizens oppressed with debt to prevail against creditors and debt collectors who act improperly.  Knowing how to use these laws has, in the past, required hiring a lawyer or getting an advanced legal education.  That is no longer the case!   Federal and State laws provide ammunition that levels the playing field for those who understand how to use these laws.  This book reveals the steps and strategies to defeat creditors, debt collectors, and their attorneys in their efforts to collect upon invalid claims, as well as those who engage in illegal conduct in the process of collection.  By understanding some basic principles and protections in the law, you can prevail against these creditors, debt collectors, and their attorneys, who intend to take your assets, invade your bank accounts, and garnish your paycheck.  Preemptive action on your part (sending appropriate letters and documenting communications) may entirely eliminate the threat, without you ever having to defend a lawsuit or file for bankruptcy. 

If a lawsuit is filed, you can defeat the case by raising proper defenses that apply to the collection case.  Statistically, 35% of all debt lawsuits are completely meritless, yet result in default judgments against the consumer 93.4% of the time, as the result of the consumer's neglect to file a proper answer and raise basic defenses. Collectors and debt buyers prey on lower to middle class Americans, knowing that they cannot afford to hire a lawyer, and that they will not likely file any answer to oppose the lawsuit. 

Finally, there is a step-by-step guide which provides the tools to level the playing field.   If preemptive action is taken (i.e. sending properly-worded retaliatory letters that you have documented violations of federal and state laws such as the federal Fair Debt Collection Practices Act (FDCPA), Truth in Lending Act (TILA), Fair Credit Reporting Act (FCRA) and other state and federal laws, most debt collectors will close their files and their attorneys will recommend that the creditor not pursue the matter further. 

This book enables you to understand and assert your legal rights and protections in times of battle, as opposed to surrendering in defeat.  Creditors and collectors who routinely commit violations of law in their efforts to collect actually owe you money for their violations, as a matter of State and Federal law.  When your family is under attack, it is time to fight.  And when you fight, you must fight to win.
