to get your mind wrapped around. Basically Schiff argues that there is NO
actual law that requires the average person to pay taxes on wages or salaries!
The IRS cleverly misleads workers into thinking that they have to file with
the IRS each year - to basically give up all their private info on what they
earned, how they earned it, how much they have had collected (withholding) and
how much they must pay. They take great pains to say that it's a "voluntary tax
system" and that people should want to participate in helping pay their fair share.
Unforunately, the IRS is the biggest bureaucracy which loves to flex its muscles
and lord it over the average worker. They feel empowered to demand payment from
indviduals and will resort to seizing personal property including cars, boats,
homes, savings accounts, IRS refunds. They have adopted their own phrases such as
saying that you have a certain "deficiency" of $x.xx dollars. That sounds like
you "owe" them that amount. Not so. They don't want to use that word or say that you
"must pay us" such and such amount. They know that in a voluntary system one cannot
be compelled to pay anything at all. Also look at "The Federal Mafia..." Irwin Schiff
He wrote in the Introduction to this 1985 book, "This book... will convince you that for over seventy years the Federal government has been illegally collecting income taxes and that the courts (if not Congress) know it... Most Americans do not realize they have no income that can be legally taxed under our income tax laws... More and more Americans are learning to recognize our ("owned men") for the usurpers they are. They are learning how to successfully fight them. This book was written to help in that struggle and to persuade YOU to join the battle."
He admits that the Constitution grants the Federal government the power to tax Americans for the "common defense." "Those, therefore, who refuse to pay income taxes because they object to this or that war... are on untenable ground." (Pg. 32)
He criticizes a Supreme Court decision based on the opinions of three Justices---"none of whom had the foggiest idea of what they were talking about. And, based upon such a totally erroneous decision, numerous, far-reaching Supreme Court decisions rest." (Pg. 92) He calls the fifty people in jail for violating IRC Section 7203 "political prisoners." (Pg. 261)
He claims that, since the employer admitted he paid an electrician less for his labor than it was worth, an electrician had no "income," as he "had no GAIN on his labor." (Pg. 227) He cites his own "Schiff Report," where he advised that a convicted person should have lied, saying that he never had any savings or checking accounts, because, "Even if the above answer is false, how can Mr. Hett be convicted of perjury? How can they use that statement against him?" (Pg. 273)
He admits that in his second trial, he presented "more law to the jury than... any jury ever saw in the history of American jurisprudence." However, "I now recognize that this was a mistake," as the judge ruled that the bulk of this was "not a defense." (Pg. 286) After citing the unsuccessful results of his attempted defenses (Pg. 308-326), he bitterly says, "these 'judges' have about as much interest in Federal tax law and in upholding the Constitution as does the Ayatollah Khomeini." (Pg. 326) Lawyers, too, are "the world's largest collection of parasites." (Pg. 389)
It is instructive to see how much Schiff modified his arguments from his 1982 book, "How Anyone Can Stop Paying Income Taxes" (e.g., abandoning the so-called "5th Amendment tax return"). Some of Schiff's books contain interesting arguments against "big government," inflation, etc., and he is always an engaging speaker. Nevertheless, while "Caveat Emptor" is a true principle, Schiff's track record suggests personal disaster for those who follow his counsel.

Federalist debates elaborating on the inclusion of all the
taxing clauses written in the constitution. You will learn
there was a very strong opposition to the federal government
having any taxing powers at all!! The only reason it was
reluctantly decided to grant the federal government any
taxing powers at all was to allow the government to have
quick access to capital ONLY in times of war (not our
failing social handouts)! You will understand the brilliant
constitutional safeguards that the founders of our constitution
devised (apportionment on direct taxes) to the potential
abuse that they foresaw (our current tax system). Follow the
Supreme Court decisions that are ignored in our current
courts from the Pollock case (reversing previous Supreme
Court cases on the definition of direct taxes) to the
Brushaber case (that held that the 16th Ammendment did not
add any new taxing powers to the constitution). In essence
the 16th amendment did not amend the constitution! Learn
why the income tax is a masterful hoax. 1) its not income
its a CORPORATE PROFIT!! 2) Its not a tax its a VOLUNTARY
This book should be mandatory reading in every law school
