Robert G. Natelson's meticulous studies of the Constitution's original meaning have been relied on repeatedly in the U.S. Supreme Court, both by justices and by the parties. Professor Natelson was a law professor for 25 years at three different universities. He taught Constitutional Law, Advanced Constitutional, Constitutional History, and First Amendment courses. He is now the Senior Fellow in Constitutional Jurisprudence at the Independence Institute in Denver, Colorado.

I loved this book as it is easy to read, and the information in it was confirmed by all the historical documents I could track down on the Yale Law Avalon site with historical documents from waaaayyyy back in history and they confirmed what Natelson wrote. Natelson has a plethora of documents and articles on the web as it should be since he is a preferred historian by SCOTUS who quotes him whenever they need an historical scholar to give them guidance. Ignore the nay sayers. There are many here in Montana where he used to be a professor of Law at the Univ of Montana, that are jealous of him and his scholarship. Buy the book and read it yourself, then judge if these naysayers know of what they speak. You will find their complaints are petty and of a whining nature - thus invalidating their complaints. You will enjoy reading all the foot notes as much as the book - at least I did and I check quite a few of the sources and have them handy to refute those here in Montana that belong to a group whose initials are JBS - an anti-constitutional group that is so weird and wicked out that John Denver and Bob Dylan wrote a song about them. That should tell you something....

If you are curious about Article 5 and the Convention of States, this is a fantastic resource for understanding exactly what a COS is and is not. There are lots of people blowing smoke about the COS, but this is a well researched and exhaustively documented explanation. You don't have to be a constitutional scholar to understand the material, presented in plain English for the non-lawyer, and you will have a thorough understanding of Article 5 when done.

Today we NEED to use the Article V of the Constitution because our federal government and those elected representatives have lost the principles, moral regard, and courage to use the Constitution as it was written. The Constitution is not a living, breathing document. It was divinely inspired and written with great concern for We the People!

The most basic rule of statutory construction is that one first examines the language of the law under scrutiny, and ONLY if that language is ambiguous are sources outside the law itself to be considered in determining meaning. Article V of the Constitution clearly states that either Congress or a convention of states may be convened “to propose” amendments to the Constitution. Only by falsely asserting in the first paragraph of this book that the language of Article V is unclear is the author then free to superimpose his belief (through research of barely relevant, outside historical sources) that state applications for a convention of states must address the same subject matter. I support a call for a COS, but one with plenary authority to consider—as the Constitution itself states—amendments to be proposed. I do NOT subscribe to the author’s belief (unfortunately adopted by the current COS movement) that state applications should or must be limited to a fixed topic or amendment. In fact, the current applications would waste the opportunity to, for example, require uniform voting requirements such as identification, and personal appearance or ballot requests for federal elections. I do not subscribe to the belief that a plenary authority convention would be a “runaway one,” because any amendment proposed would have to be ratified by 3/4 of the states in order to take effect. The author even admits in one section that attempts by the states to try and impose conditions on the convention might be illegal, yet he concludes with a doctrine and even forms which do exactly that. As an alternative, I strongly recommend Mark Levin’s “Liberty Amendments,” which provides a much more comprehensive list of amendment proposals which could—and should—be considered by a more plenary COS.
