Warranty Information
International Limited Warranty. Livescribe warrants the Pulse smartpen to be free from defects in materials and workmanship under normal use for a period of ninety (90) days from the date of original direct or retail purchase. This warranty is void if the product has been damaged by accident or unreasonable use, immersion in water, neglect, abuse, improper maintenance, or other causes not arising out of defects in workmanship or materials of the product. All warranty claims are subject to: (1) you notifying Livescribe of the warranty claim within the warranty period, (2) Livescribe verifying the existence of a defect in the product and (3) receipt of valid proof of your purchase and the date of your purchase. Your exclusive remedy shall be, at Livescribe's option, to have it repaired or receive a replacement Pulse smartpen. All shipping costs, both to Livescribe and back to the user/owner must be prepaid by the user/owner. Before returning the Pulse smartpen, please contact the Livescribe Customer Service Department for instructions.
In the event that a product under warranty is repaired or replaced, the replacement will be covered under the original warranty or for 30 days, whichever is longer. Repair or replacement is your exclusive remedy, and Livescribe’s exclusive liability, under this warranty. The limited warranty set forth herein is the only warranty made to you and is provided in lieu of any other warranties (if any) created by any documentation or packaging. This limited warranty gives you specific legal rights.
Disclaimer of Warranties. You expressly acknowledge and agree that use of the Livescribe desktop software, Pulse smartpen and other products and services is at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy and effort is with you. Except for the limited warranty set forth above and to the maximum
Extent permitted by applicable law, the Livescribe desktop software, Pulse smartpen, products and services are provided "as is", with all faults and without warranty of any kind, and Livescribe and Livescribe's licensors (collectively referred to as "Livescribe") hereby disclaim all other warranties and representations, either express, implied or statutory, including, but not limited to, the implied warranties of merchantability, of satisfactory quality, of fitness for a particular purpose, of accuracy, of quiet enjoyment, and non-infringement of third party rights. No oral or written information or advice given by Livescribe or any Livescribe authorized representative shall create a warranty. Should the Livescribe desktop software, Pulse smartpen, or services prove defective, you assume the entire cost of all necessary servicing, repair or correction.
Limitation of Liability. To the extent not prohibited by law, in no event shall Livescribe be liable for personal injury, or any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption or any other commercial damages or losses, arising out of or related to your use or inability to use the Livescribe desktop software, Pulse smartpen, or services, however caused, regardless of the theory of liability (contract, tort or otherwise) and even if Livescribe has been advised of the possibility of such damages.
In no event shall Livescribe's total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

The pen is much too thick. It's downright uncomfortable in the hand. I hate holding it. It's hard taking notes with such an uncomfortable clunky pen.
Ink quality, even if it didn't go dry every few seconds, is terrible.
Software sucks. Seriously. I thought that maybe Lotus Notes might've been the worst piece of software ever written. I was wrong. Livescribe software is the absolute worst. It's written in Java, so it's dog slow. You'll wait an unreasonable amount of time for even the simplest of operations like switching from one piece of audio to the next. It's also non-intuitive. I'm not an Apple fanboy (in fact, I dislike Apple products) but the ONE thing that Apple got right is intuitive user interface. A good piece of software should not require instructions. Nobody needs to be instructed on how to use iTunes... it's just ... intuitive. But this piece of software is a piece of junk and utterly non-intuitive. Even things that should be very simple and basic end up being Googled questions. Hate it.
Great for Lawyers taking depositions too. You can even leave it recording when leaving the room in case your client is not telling you everything you need to know. Over all a great little device. I still use if from time to time. you can also buy a microphone for the pen which helps reduce the scratching noise you can get when taking notes. Great for lecture halls sitting in the back. Long record time. I managed to record an 8 hour conference on my pen and still have room for lots more content.
AND I was sitting in the very back of the room and could hear the entire lecture on playback with no problems. The cons are only the noise from taking notes but a mic can reduce that.
I had problems with the original item; LiveScribe customer service quickly made the problems go away. Great pen; does everything it says it will do. I'm still not sure I use it legally each time I use it, however. Would you like to be recorded if you did not know you were being recorded? In some states that's legal; in others it is not. It's not always clear in some states what "a reasonable expectation of privacy" means. But, handled carefully and ethically, this pen can ease a lot of research-oriented problems.

There seem to be two kinds of reviews here: those who love the pen and those who try to love it but the pen will not allow them to. I am in the latter category. My pen arrived today. It performed flawlessly for one hour and allowed me to take audio and text notes at a lecture. The pen performed exactly as advertised. I tried it again later this evening. Nothing. It keeps great time and writes like any pen should do. But it no longer functions as a recorder -- either aurally or visually. I followed the reset instructions. The pen reset itself, but still did not work properly. I followed the even more arcane instructions buried deep in the support pages that require one to turn the pen upside down, push on the point and look for a dim red light. Nothing. I contacted the company and asked for assistance. I will update this review as appropriate. Meanwhile, I suggest holding off any planned purchase.

Update 1: called customer service today. an actual human answered after 2 rings. I explained the problem. once he confirmed i had gone through the suggested procedures for correcting the problem (to no avail), he said the company would send me a new pen. I asked how frequently this uncorrectable problem ("a defective FSR") occurred. He said the problem happened in "1.6% of the pens." Promised to get the pen to me in 2 business days. So far customer service has been a positive experience. Let's see what happens with the new pen.

Update 2 -- my replacement pen arrived a few days after I requested a replacement. It pushes my rating to 3 stars (but i do not know ow to actually change that.)so far the new pen works as advertised, so i am off on my adventure to learn about how to use it effectively (meaning I should not have to think about the technology; it should just work). I have done some research on whether it is legal to record someone if they are in a public place (like a public meeting) with what I assume is no expectation of privacy. The state I live in (oregon) does not seem to be clear about that issue. so I ask myself if i would like to be recorded without my knowledge, and my "do unto others" answer is "no." I plan on using "the pen" in a public meeting tomorrow.

Update 3 -- i am becoming quite fond of this pen and the equipment that goes with it. i think i have recorded a total of 10 hours of lectures, and the pen informed me i have space left to record 74 more hours before i have to delete anything. the uploading to my computer has been flawless. (although i did neglect to follow the directions before i started a new notebook, so i was unable to upload the audio portion of my notes successfully. the pen was able to record the audio, but i could not upload it. my error). the only remaining problem i have is the legality/ethics of recording something without asking the permission of everyone in the room. i looked at the law in the several states i travel to, and it is unclear to me. great product.
