What You Need
International Limited Warranty. Livescribe warrants the Pulse smartpen to be free from defects in materials and workmanship under normal use for a period of ninety (90) days from the date of original direct or retail purchase. This warranty is void if the product has been damaged by accident or unreasonable use, immersion in water, neglect, abuse, improper maintenance, or other causes not arising out of defects in workmanship or materials of the product. All warranty claims are subject to: (1) you notifying Livescribe of the warranty claim within the warranty period, (2) Livescribe verifying the existence of a defect in the product and (3) receipt of valid proof of your purchase and the date of your purchase. Your exclusive remedy shall be, at Livescribe's option, to have it repaired or receive a replacement Pulse smartpen. All shipping costs, both to Livescribe and back to the user/owner must be prepaid by the user/owner. Before returning the Pulse smartpen, please contact the Livescribe Customer Service Department for instructions.
In the event that a product under warranty is repaired or replaced, the replacement will be covered under the original warranty or for 30 days, whichever is longer. Repair or replacement is your exclusive remedy, and Livescribe’s exclusive liability, under this warranty. The limited warranty set forth herein is the only warranty made to you and is provided in lieu of any other warranties (if any) created by any documentation or packaging. This limited warranty gives you specific legal rights.
Disclaimer of Warranties. You expressly acknowledge and agree that use of the Livescribe desktop software, Pulse smartpen and other products and services is at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy and effort is with you. Extent permitted by applicable law, the Livescribe desktop software, Pulse smartpen, products and services are provided "as is", with all faults and without warranty of any kind, and Livescribe and Livescribe's licensors (collectively referred to as "Livescribe") hereby disclaim all other warranties and representations, either express, implied or statutory, including, but not limited to, the implied warranties of merchantability, of satisfactory quality, of fitness for a particular purpose, of accuracy, of quiet enjoyment, and non-infringement of third party rights. Livescribe does not warrant against interference with your enjoyment of the Livescribe desktop software, Pulse smartpen, products or services, that the functions contained in the Livescribe desktop software, Pulse smartpen, products or services will meet your requirements, that the operation of the Livescribe desktop software, Pulse smartpen or services will be uninterrupted or error-free, or that defects in the Livescribe desktop software, Pulse smartpen or services will be corrected. No oral or written information or advice given by Livescribe or any Livescribe authorized representative shall create a warranty. Should the Livescribe desktop software, Pulse smartpen, or services prove defective, you assume the entire cost of all necessary servicing, repair or correction.
Limitation of Liability. To the extent not prohibited by law, in no event shall Livescribe be liable for personal injury, or any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruption or any other commercial damages or losses, arising out of or related to your use or inability to use the Livescribe desktop software, Pulse smartpen, or services, however caused, regardless of the theory of liability (contract, tort or otherwise) and even if Livescribe has been advised of the possibility of such damages.
In no event shall Livescribe's total liability to you for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.

But there are major flaws in the concept as executed that suggest this product is not going to be an everyday arrow in your arsenal.
Other reviewers have already noted that the pen is really too fat, but that's minor in the scheme of things.
The major problems are with the software; the product is an engineer's dream with real world defects:
1. You cannot manipulate or reorganize your notes on your computer.
A. So if you have two pages of notes and diagrams you can't put two points on different pages together on one page or do any other kind of shuffling. You can't move anything, period.
B. You can't rename a page, period. We have more than one project in my shop. I can't put pages 2, 7, and 12 in a folder marked "Smith Project Notes." True, I can turn the page into a pdf and then move the pdf to the Smith directory in my hard drive, or I can rename a "session" and then search for notes with that name all but this is cumbersome and turns me into a file clerk when what I really want is something that makes my work easier; not something that adds extra work. (Also -see point A- I can't turn PART of a page into a pdf, so the pdf I create may also contain notes of the "Jones" project unless I keep my notes for every project on separate pages)
THERE SHOULD BE A SIMPLE WAY TO COPY/CUT/PASTE PARTS OF A PAGE AND A WAY TO REORGANIZE PAGES INTO FOLDERS
2. There are situations -say behind closed door meetings- where I would prefer that the other party not know that he or she is being recorded. But the lit-up screen on the pen almost guaranties that party saying "What do you have there and what are you doing?" Unless you want to lie, you're going to have to day "I am recording this conversation with this device."
THERE SHOULD BE A FUNCTION THAT SHUTS OFF THE SCREEN ON THE PEN
3. In the real world you write a note AFTER you've heard something noteworthy. In this gadget, when I tapped on my written note I heard what was said AS I was writing the note. Since
I wrote the first drsaft of this review I learned that there IS a way to have it capture a 5-second period before I put pen to paper, but the pen wasn't set up that way when I got it and I learned about it from an engineer who responded to my first review, which complained about the time delay between what you hear and what you write. If there are answers to questions 1 and 2 I simply don't understand how to do these things, then the manual is not helpful and the software is not sufficiently intuitive. But I would like to know how to do these things if I can.
Minor disappointment: The on-line site for my LiveScribe notes currently has a size limitation - unintended - of about 20 megs. I'm told that is soon to be fixed.
This pen, and the $50-cheaper 1-G version, are highly recommended.
Design suggestions: I wish it weren't cylindrical; it rolls off tables. It has no pocket clip. And it has no cap for the pen point.
But it feels good in my hand; the battery charge lasts a long time; the audio quality, both recording and playback is superb; and the thing just works. I love it!
Great for Lawyers taking depositions too. You can even leave it recording when leaving the room in case your client is not telling you everything you need to know. Over all a great little device. I still use if from time to time. you can also buy a microphone for the pen which helps reduce the scratching noise you can get when taking notes. Great for lecture halls sitting in the back. Long record time. I managed to record an 8 hour conference on my pen and still have room for lots more content.
AND I was sitting in the very back of the room and could hear the entire lecture on playback with no problems. The cons are only the noise from taking notes but a mic can reduce that.
