Understand before you buy this book that you're buying a book about Constitutional Law and the intended audience is Con Law scholars. If you are not the intended audience and want to find out more about Roe v. Wade, read the full decision yourself for free at Oyez. I've read a couple of his other books and I was really looking forward to this one, he didn't disappoint. It's sharp and well researched although he takes his usual digs at Conservatives and sometimes oversimplifies their view to make his view seem more logical.

Legal scholars try to re-argue the Roe v. Wade case. I guess it was not what I was looking for. I was looking for what really happened and what reasoning or other things contributed to the case and its decisions. This book is too speculative. I'm not sure who it was written for or who would like it. I should have believed what the subtitle said.

A must-read for anyone who wants to more fully understand the most controversial and divisive Supreme Court decision of all time. While the opinions of the fictional Balkin Court make clear that the rigid trimester framework ultimately adopted by Justice Blackmun was the least attractive and/or logical means of recognizing a fundamental right to abortion, I was left wondering: could the members of an all-male Court really have done anything else? The undeveloped state of Equal Protection/sex discrimination jurisprudence at the time Roe was handed down leads me to believe not.

Balkin says a line must be drawn but leaves that for legislators. Politics are to determine humanhood and personhoon? Leaving opinions and morality out of it, biology clearly shows a fertilized egg until death is a living human being.
