2019 All Voices Film Festival Entry Rules and Regulations

The following rules and regulations (“Rules and Regulations”) govern the submission of films (each hereafter referred to as “Title”) to Prime Video Direct for consideration for the first annual Prime Video Presents All Voices Film Festival (hereafter referred to as “Festival”), sponsored by Amazon. All information contained in this document shall supersede the contents of the information and FAQs located at [www.amazon.com/allvoices] (https://www.amazon.com/allvoices) and should be reviewed alongside the terms of the [Prime Video Direct Digital Video License Agreement] (https://videocentral.amazon.com/home/agreement) (“DVLA”) and [Prime Video Direct Terms And Conditions] (https://videodirect.amazon.com/home/help?topicId=G201985470&ref_=avd_sup_G201985470) (“Terms and Conditions”). By submitting a Title, you acknowledge that you have read and agree to be bound by these Rules and Regulations, the DVLA, the Terms and Conditions and the decisions of Amazon and the judges, and that you and your Title into the Festival satisfy all eligibility requirements.

1. Eligibility Requirements

To be eligible for consideration:

(1) You must fully comply with these Rules & Regulations, the [Terms and Conditions] (https://videodirect.amazon.com/home/help?topicId=G201985470&ref_=avd_sup_G201985470) and the [DVLA] (https://videocentral.amazon.com/home/agreement). (2) You must be located in the U.S. (3) Titles must comply with all requirements to be included in Prime Video, including the [technical specifications] (https://videocentral.amazon.com/home/help?topicId=G201973700&ref_=avd_sup_G201973700) and [content policy guidelines] (https://videocentral.amazon.com/home/help?topicId=G201986500&ref_=avd_sup_G201986500). These include Title requirements such as (i) HD picture quality, (ii) have closed captions or subtitles, and (iii) have a rating of “R” or less (or an equivalent through local rating agencies). (4) Titles must be submitted via the [Prime Video Direct submission process] (https://videodirect.amazon.com/home/landing) as a "Standalone" film in the "Short Films" category, with the offer availability set to "US" and "Prime". (5) The Title must meet the following criteria: a. The writer, director, cast or theme of the short must reflect underrepresented communities. This includes but is not limited to people of color, ethnic, gender and religious minorities, members of the LGBTQI community, people with disabilities, veterans, young, aspiring filmmakers as well as older adults, and other groups that are underrepresented or marginalized. b. The Title must be standalone digital audio-visual short film, including documentaries, narratives, animation, and experimental films. c. All submitted Titles must be 40 minutes or less in length, including credits. d. Titles must have a storytelling element; shorts that are strictly intended as commercial spots will not be considered. e. Titles must remain active and accessible for streaming on Prime Video from the date of submission through October 1, 2019. By submitting an application, you agree that Prime Video is authorized to host your Title on the Prime Video through October 1, 2019 in connection with the Festival.

It is your sole responsibility to ensure that the Title is properly submitted. The Festival reserves the right to disqualify or reject any submission in its sole discretion, including those not in compliance with these Rules and Regulations, the Terms and Conditions and DVLA, and may do so without notice to you. The Festival reserves the right to consider for inclusion Titles received at any time and through any means, including those other than as outlined in these Rules and Regulations.

Eligibility Note: There are no premiere requirements or prior screening restrictions. Titles may have been screened at any number of festivals or other public theatrical exhibitions anywhere in the world, broadcast or streamed on television or the Internet, and/or released via any home video or other public distribution platform in any country. You may submit multiple entries.

2. How to Enter

Step 1: Sign up for [Prime Video Direct] (https://videodirect.amazon.com/home/landing) and accept the terms of the [DVLA] (https://videocentral.amazon.com/home/agreement). Step 2: Publish your film through Prime Video Direct in compliance with the [publishing standards] (https://videodirect.amazon.com/home/help?topicId=G201978320&ref_=avd_sup_G201978320) and the [festival submission criteria] (https://www.amazon.com/b?node=18338484011). Step 3: Submit your film for the festival through the [Official Entry Form] (https://www.amazon.com/forms/7123c56a-e5f9-4583-ad8c-848388141933).

3. Key Date and Entry Fees

Submissions open: April 8, 2019 (3 p.m. ET) Deadline for submissions: May 20, 2019 (11:59 p.m. ET) Entry Fees: None

4. Awards

We will award one (1) Jury Prize and four (4) First Prizes.

The one (1) Jury Prize consists of a $25,000 royalty bonus, plus a paid trip for the winner and one (1) guest, originating within the U.S., to meet with Amazon Studios executives in Culver City, CA. The award package consists of: • Roundtrip economy class airfare for winner departing from an airport near the winner’s residence (as determined by Amazon) and arriving at an airport in or near Los Angeles, CA (as determined by Amazon); • Two (2) nights standard hotel accommodations for winner (single room, double occupancy) at a hotel in or near Culver City, CA (the “Hotel”); and • A meet with Amazon Studios executives.

Each of the four (4) First Prizes consist of a $10,000 royalty bonus.

Awards are subject to change by Amazon in its sole discretion. Royalty bonuses are in addition to license fees paid in accordance with the DVLA. Winners will be required to submit his/her social security number or tax payer ID number to Amazon in order to claim the award.

The trip to Culver City, CA will be scheduled at a time convenient for Amazon, in consultation with the Jury Prize winner. Amazon does not guarantee that any particular executive will be available to meet with the Jury Prize winner. Any tickets awarded as part of the award will be subject to the terms and conditions set forth by the issuer and are valid only on the date(s) printed on the tickets. Other restrictions may apply.

If the Jury Prize winner resides within a 125-mile radius of the Hotel, air transportation may not be provided and winner may be provided with ground transportation to/from winner’s residence to Hotel in lieu thereof. Winners must have and are solely responsible for obtaining all necessary identification and/or travel documents required for travel, including, but not limited to, a valid U.S. driver’s license or government issued passport (if applicable). Upon any prize forfeiture, no compensation will be given.

Award eligibility is subject to restrictions or conditions imposed by applicable laws and regulations (international, federal, state or otherwise), and the award recipients are responsible for all applicable taxes, customs, tariffs, insurance and similar charges or costs, if any. Unless otherwise agreed by the Festival in writing, awards will be given to you, the applicant, on behalf of the Title and will be awarded approximately 90 days after the finalists are announced.

Entering the Festival does not guarantee that you will win an award or derive any other benefit. The awards are awarded at the sole discretion of the jury. Awards are subject to change by Amazon in its sole discretion.

5. Judging Currently, the Festival expects the jury to include the co-Head of Movies at Amazon Studios (Julie Rapaport), Head of Diversity at Amazon Studios (Latasha Gillespie) and Founder and CEO of IMDb (Col Needham); however Amazon reserves the right to change the jury members in its sole discretion.

Between June 3-24, 2019, Amazon will select the top submissions based on U.S. customer engagement. Customer engagement metrics include, but are not limited to, how many people watch, how long they watch, and customer ratings. We encourage you to promote your film. A jury will review these top submissions and select their favorites in early August 2019. We will notify the potential winners using the contact information submitted as part of the submission process. The final selection will be determined by the film’s message, overall quality, execution, representation of underrepresented communities, and the judge’s discretion.

All selection decisions are made in Amazon’s sole discretion, are final and non-reviewable.

6. General Rules

Amazon will not provide you with any comments or feedback regarding the Title, any information relating to the manner in which the Title is, will be, or was reviewed; any reasons why the Title may not be eligible for the Festival or was not accepted; or any other information relating to the Festival’s review, consideration and/or selection process regarding the Title specifically or submissions generally. Amazon may in its sole discretion cancel, terminate, modify or suspend the competition at any time.

It is your sole responsibility to secure authorization and permission from the copyright owner(s) of any and all trademarked and/or copyrighted content or materials included within the submitted Title. By submitting a Title to the Festival, you represent that the Title (a) is your original creation; (b) has not been copied or derived in whole or in part from any other work; (c) does not violate or infringe any copyright, trademark, privacy or publicity right, or other personal, proprietary, or intellectual property right of any person or entity; (d) is not defamatory, libelous, obscene, or otherwise illegal; and (e) is your sole and exclusive property . You further represent that you have complete, worldwide distribution rights for the Title and that you have received the written consent of any person (or parent or legal guardian if such person is a minor) who appears in the Title. Amazon may at any time request proof of such consent and disqualify any Title for which such consent cannot be provided.

You agree to indemnify and hold harmless Amazon, and any entity involved in any aspect of the Festival (including judging or provision of prizes), and each of their respective affiliates, and each of the foregoing entity’s respective officers, members, directors, shareholders, employees, agents and representatives (collectively, the “Released Parties”), for any action or claim brought by a person whose consent you did not obtain. The Title, along with your name and/or likeness, may be posted on any website owned and/or operated by Amazon or any of its affiliates, Amazon’s pages on any social media websites. You agree (for yourself and your heirs) that the Released Parties will have no liability, and will be held harmless by you to the maximum extent permitted by law for any liability, loss, injury, or damage to property or to person, including death, and reasonable attorney’s fees and court costs, due in whole or in part, directly or indirectly, by reason of participation in the Festival, or by reason of the acceptance, possession, use or misuse of any prize (including any travel/activity related thereto), even if caused or contributed to by the negligence of any of the Released Parties.

Festival is governed by the laws of the United States and the State of Washington. As a condition of participating in this Festival, you agree that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Festival, will be resolved individually, without resort to any form of class action, exclusively before a court located in King County, Washington having jurisdiction. You hereby waive all rights to claim punitive, incidental, or consequential damages, including attorneys’ fees, and you further waive all rights to have damages multiplied or increased. Festival is void where prohibited by law.
