Letting him/her use the nurse's room is a fair compromise. It's not implying he's sick. And it really can't be denied that he's not like most kids. That doesn't mean he's bad or wrong in any way, but to ignore that he's different can be harmful too.

Yeah I get all that, but still the kid isn't a girl. He just isn't. I'd be pissed if I took some girl home from the bar and it turned out she had a penis. Sure I'd make the best out of a bad situation, but still I'd want my money back from false advertising.

It is only an issue when boys want to do things meant for girls. Such as competiting in the Olympics as a girl, WNBA, LPGA, using the girls room, etc. Mentally aside, that doesn't change the facts. He is a boy. I can't mentally claim to be a minority and benefit from affirmative action.
