Amazon.com Product Customization Program Terms and Conditions



Welcome to Amazon. As used in these terms, "we" or "Amazon" means Amazon Digital Services, Inc. and "you" means the individual or entity purchasing customized products on Amazon.com. Any individual or entity that wants to purchase customized products on Amazon.com must accept these terms without change. BY CLICKING THE 'USE THIS DESIGN' BUTTON, YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, THE AMAZON.COM PRIVACY NOTICE, CONDITIONS OF USE AND ALL GUIDELINES.

Customization. You can submit your own materials, including photographs, illustrations, graphics and text, and/or select from a gallery of images to create customized products. You may only submit materials for which you own all rights or you must have the authorization of the person who does own those rights.

License Grant for Your Materials. You hereby grant to Amazon, its affiliates and sublicensees (including third-parties who provide customized products and related services) a worldwide, nonexclusive, royalty-free, perpetual right and license, in connection with your purchase of customized products, to (a) reproduce, distribute, transmit, and display the materials you submit, in any manner and media, including all trademarks, trade names, and the names and likenesses of any individuals that appear in your materials, (b) modify, adapt, translate and create derivative works from those materials, in any manner and media, and (c) sublicense the foregoing rights to any third party, with or without a fee.

Guidelines and Restrictions. You agree to submit materials to us in accordance with all guidelines for use posted on the Amazon web site or of which you are otherwise notified ("Guidelines"). In particular, you agree not to submit materials that are unlawful, pornographic, libelous, defamatory, tortious, obscene, or racially, ethnically or otherwise objectionable, or that otherwise violate general Amazon community standards. We expressly reserve the right to remove or not accept any materials that we deem to be in violation of these terms, applicable laws or our community standards in our sole discretion.

Representations, Warranties and Indemnities. You represent and warrant to Amazon and its affiliates and sublicensees that (a) you have the right to grant the licenses set forth these terms, including all rights necessary for the reproduction, distribution, and other use of the materials by Amazon and its affiliates and sublicensees as permitted hereunder, and (b) the materials you submit, and Amazon's and its affiliates' and sublicensees’ exercise of their rights hereunder, do not and will not violate, misappropriate or infringe any intellectual property right, including but not limited to trademark rights, copyrights, moral rights or publicity rights of any third party. You agree to indemnify, defend, and hold Amazon and its affiliates and sublicensees harmless from all claims, liabilities, damages, and expenses (including, without limitation, reasonable attorneys' fees and expenses) arising from any breach of these terms.

Returns. The condition of the item you buy from third-party sellers on Amazon.com and its timely delivery are guaranteed under the Amazon A-to-z Guarantee. While most sellers offer a returns policy equivalent to Amazon.com's, some seller returns policies may vary. You can view each seller's return policy in the Online Returns Center. Amazon Intellectual Property. Amazon or its affiliates or licensors are the owners of all intellectual property rights in the gallery images, including, without limitation, all trademarks, trade names, trade dress, and copyrighted material. These terms and your purchase of customized products do not grant you any license to or right in the gallery images, except the opportunity to purchase customized products featuring such images.

Other Terms. The Amazon.com Privacy Notice, Conditions of Use, and this service’s Guidelines (including all future changes) are incorporated by reference into these terms.
