Welcome to the terms of use for the product ordering service known as Amazon Dash Replenishment (the "Service," which includes Software and other support and related services). This is an agreement between you and Amazon Services LLC (with its affiliates, “Amazon” or “we”). Before using Amazon Dash Replenishment, please read these Amazon Dash Replenishment Terms of Use, the Amazon Device Terms of Use (if using an Amazon device), Coupon Terms and Conditions (if applying a coupon), Amazon.com Privacy Notice, the Amazon.com Conditions of Use and the other applicable rules, policies, and terms posted on the Amazon.com website or otherwise provided by Amazon, which also govern our respective rights and obligations (collectively, this “Agreement”). By using Amazon Dash Replenishment, you agree to be bound by the terms of this Agreement. If you do not accept the terms of this Agreement, then you may not use Amazon Dash Replenishment.
Definitions
For the purpose of these Amazon Dash Replenishment Terms of Use:
"Order" means any product order placed using the Service.
"Device" means any Amazon approved and authorized Internet connected device that utilizes the Service, including the Amazon Dash Button.
"Site" means any Amazon approved and authorized website, mobile application or other online point of presence that utilizes the Service.
"Software" means all software (including updates and upgrades to that software) and any related documentation that we make available to you or any third party maker of Devices or Sites for use in connection with the Service.
Eligibility. A list of eligible products that may be ordered through the Service, which is subject to change, is available here for Dash Button and through Manage Your Content and Devices for other Devices. The Service is available to customers shipping to addresses in the United States. Orders placed through the Service are not currently eligible for AmazonSmile donations.
Offers, Orders, Cancelations and Returns. Offer details may change as you reorder products through the Service over time (for example, price, taxes, availability, shipping charges, and the seller). Each Order will be subject to the offer details at the time you place that Order. You can always view current offer details through the Service, and see the details for each Order in Your Orders. You can learn more about offers here. If your product is unavailable when your Order is placed, we may fulfill your Order with a similar substitute product that we believe will meet your expectations. After an Order is placed, you have a window of time to confirm details and make any changes to that Order - to learn more, go to Change Your Order Information. You also may return your Order subject to the Amazon.com Returns Policy.
Payment. Orders placed using the Amazon Dash Button will be automatically charged to the payment method and shipped to the address associated with your 1-Click settings. Orders placed through Sites will be will be automatically charged to your default payment method and shipped to your default shipping address. Orders placed using other Devices will be automatically charged to the payment method and shipped to the address that you designate during Service setup. If your designated payment method is declined for payment, we may charge another card on file. The total cost charged to you for each Order will be the price of the product at the time the Order is processed less any applicable discounts, plus any applicable sales tax and shipping-related charges. Any Amazon.com eligible promotional credit balances on your Amazon.com customer account may be applied toward the balance of your order before charging any remaining balance to your payment method. Some Orders may be eligible for a coupon discount.
Devices and Use of Software. Service Enabled Devices require an Internet connection to access the Service. If your Device is located in an area in which it cannot maintain Internet connectivity, you may not be able to use some or all of the Service. You may use the Software only in connection with the Service. For additional terms that apply to the Software, see the Additional Amazon Software Terms contained in the Amazon.com Conditions of Use and any additional legal & compliance notices contained in the app or website used to setup your Device. Devices include third party devices that Amazon does not manufacture or develop. Amazon has no responsibility or liability for such devices. If you use a third party Device, we may exchange Service related information with the maker of that device, such as your estimated Order delivery date and other Order related details. Your use of any third party Device is subject to this Agreement and any third party terms applicable to such Device. When using a third party Device, you are responsible for any information you provide to the third party. Any third party’s use of information you provide it will be subject to any privacy notice or other terms that the third party may provide to you. Makers of third party Devices may change or discontinue the functionality or features of their Devices.
2. General
Information Received. The Software will provide Amazon with information about use of your Device and your interaction with the Service (such as available memory, operational status, battery life, signal strength, product selection, order frequency, and IP location data). Information provided to Amazon may be stored on servers outside the country in which you live. We will handle any information we receive in accordance with the Amazon.com Privacy Notice.
Changes to the Service; Amendments. We may change, suspend, or discontinue any or all of the Service at any time without notice. We may amend this Agreement at our sole discretion by posting the revised terms on the Amazon.com website. Your continued use of the Service after the effective date of the revised Agreement constitutes your acceptance of the terms, including for any future Order placed using a previously configured Device or Site.
Termination. Your rights under this Agreement will automatically terminate without notice if you fail to comply with any of its terms. In case of such termination, Amazon may immediately revoke your access to the Service. Amazon’s failure to insist upon or enforce your strict compliance with this Agreement will not constitute a waiver of any of its rights.
Disputes/Binding Arbitration. Any dispute or claim arising from or relating to this Agreement, the Service or any Device or Site is subject to the binding arbitration, governing law, disclaimer of warranties, limitation of liability, and all other terms in the Amazon.com Conditions of Use. By using the Service, you agree to be bound by those terms.
Disclaimer of Warranties and Limitation of Liability. WITHOUT LIMITING THE DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY TERMS IN THE AMAZON.COM CONDITIONS OF USE, UNLESS OTHERWISE REQUIRED BY APPLICABLE LAW, IN NO EVENT WILL OUR OR OUR LICENSORS’ AGGREGATE LIABILITY UNDER THIS AGREEMENT WITH RESPECT TO ANY CLAIM EXCEED FIFTY DOLLARS ($50.00).
Severability. If any term or condition of this Agreement is deemed invalid, void, or for any reason unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining term or condition.
